<H2>FurBid Policies and User Agreement</H2><BR><H4>Last updated: 11/28/2001</H4></center>

<P><H3 align=center>Read this! Signing up constitues full agreement and understanding of the Policies of FurBid</H3></P>

<P><B>Bidding</B>: By bidding on an item, you are signing a legally binding contract, in which you acknowlege you have adequate funds available to purchase the item. Upon close date being reached on an item, or 5 minutes after the final bid on the item (whichever occurs later), the item shall be marked as closed by the software. At that time, an e-mail will be sent to the seller, informing them to contact the highest bidder that the item is closed, and what the final bid was. The highest bidder is REQUIRED to pay the seller the agreed-upon price (the highest bid). Failure to pay sthe seller upon auction close constitutes fraud, a criminal offense. All sales are final, unless specifically states by the seller. All disputes over highest bids shall be ignored by the site administrator; take it up with the seller if you feel you got the higher bid but was listed as outbid. The final highest bid is determined by the auction script's determinations of when the final bid was placed. All highest bids are final; if a debate arises over who got the highest bid, it is the seller's responsibility to work it out. FurBid takes no responsibility for bidders misrepresenting themselves in order to unscruplessly aquire an item.</P>

<P><B>Bidding on one's own item</B>: It is against FurBid's policies for any seller to bid on their own auction. Such practices are usually used by dishonest sellers to drive up the price of their auctions. If a seller is found to have willfully bid on their own auction to drive up the price, and the seller is the highest bidder at item close, the user that bid before the seller is the highest bidder. The seller will be warned about bidding on their own auction. Chronic abusers will be removed from FurBid.<br>Note: if you accidently posted your auction with a starting bid lower than you intended, delete your auction and repost it.</P>

<P><B>Sniper Bidding</B>: To attempt to control the practice of sniping, in which a buyer will bid in the last few seconds of an auction in order to ensure a victory, FurBid's software will hold an auction after close for five minutes. During that time, additional bids may be placed on the auction. Each time a bid is placed, the clock is reset to 5 minutes. Five minutes after the final bid, the auction will be closed completely. In theory, this feature works consistantly. If it's a little off, it may be due to the server clock drifting, or your browser taking too long to submit the bid. FurBid really can't do much about that, sorry.</P>

<P><B>Selling items</B>: FurBid restricts items sold to things of furry-related nature, furry being defined as "Any anthropomorphic or therianthrophic creature". Sellers must provide accurate information about the item they are selling. Sellers must be permitted to sell the item they are selling, under the law of their country (that means no underage furs selling adult items, for one!). All material that is adult in nature <B>MUST</B> be sold under the "Yiffy Items" or "R-rated" categories; see the section below, "Selling Adult Items" and "Selling Adult Items of a Sexual Nature" for info on adult items; see "Definitions of the Ratings" for ratings definition. FurBid administrators may edit or delete auctions for any reason, including, but not limited to, violation of the ToS.</P>

<P><B>Selling of adult-rated material of a sexual manner</B>: Any material that can be deemed pornographic, such as a drawing depicting sexual activity or other adult material (i.e. in which a character(s)' primary sexual characteristics, or genitalia, are prominately visible), <B>MUST</B> be sold under the <B>Yiffy Items (NC-17)</B> category. Also, any such image featuring children involved in any sexual act, in any way, is not allowed on FurBid. Any items found to be in the wrong category will constitute a warning message to the seller and deletion of that item from the auction. If a second offense occurs, the seller will be banned from FurBid permanently. This policy is to protect our younger viewers (face it, not every fur is a legal adult) and to protect FurBid from lawsuit pertaining to pornography peddling.</P>

<P><B>Definition of the Ratings</B>: So as to alleviate some confusion, here are the standards that FurBid uses to categorize art, zines, plushies and other things. <B>General Audience to PG-13</B>: Items that you could show to your mother and she (probably) wouldn't have a cow about it. By "mother", we mean the traditional mother, the type that is offended by adult material being seen by the childred. YMMV (your mother may vary). Primary sexual charastics are covered up, folks! Breasts are covered by at least a small bikini top or something. Furs of all ages are welcome to browse and bid in this category. <B>R-rated</B>: Tasteful nudity falls under this category. Secondary sexual charastics (breasts) may be visable, even showing nipples. Primary sexual characteristics (genitalia) may be uncovered by clothing, but must be covered by fur, scales, feathers or some other natural covering. It goes without saying that no sexual depictions are allowed in this category. Minors (persons under the legal age in their country of origin) may view most pieces in this category, but may not bid. <B>NC-17</B>: This is the "every other thing" category, for the most part. You've got your spooge here, your sex, your tentacles, whatever strikes the artist's fancy. Due to the graphic nature of most of the items in this category, no one under the legal age of their country of origin may look in this category, let alone bid on or sell any items in it.</P>

<P><B>Marking of Adult Items</B>: If a seller wishes to post an adult auction, the auction title and description must clearly indicate the adult nature of the item. This is to help buyers choose with auction(s) to view, as well as to help re-categorize any mis-placings of auctions that may occur.</B></P>

<P><B>Copyrighted characters/lyrics</B>: No seller may sell any art, music, video or other product containing copyrighted characters or lyrics, without the copyright holder's express <B>written</B> permission. The only exception is if the seller is simply reselling "original material" created by the <B>copyright holder</B>, meaning that the item is not a derivative work of another item, and the characters/lyrics/etc are not used without permission.

<P><B>Registration</B>: The registration process creates your bidder/seller record, which keeps track of who you are, where you live, what you've bid on and what you've sold. It is vital that all information in your record is accurate. If there is an inconsistancy in your record, such as your address being wrong, the items you bid on will not get to you. Therefore, having all your contact info be accurate and complete is required to keeping an account on FurBid. Your records are private and shall not be disclosed/sold/leased/etc. to third parties. The only person who shall see part of your record is the seller of items you bid on, and only if you get the highest bid. The information revealed to the seller in this case would be your address, so the seller knows where to ship the item. Under no other circumstances will your information be disclosed. By creating an account, you acknowlege full agreement to and understanding of FurBid's policies.

<P><B>Privacy</B>: FurBid, in the course of facilitating sellers and buyers coming together to make a transaction, stores and collects some information. FurBid does not and will not disclose any identifying contact information or usage statistics to any third party, unless required to by law or by a mutual partnership. IP addresses are collected for users requesting their username and/or password be retreived for them. What items a user sells or bids on are stored by FurBid for the sole purpose of sending e-mails to buyers and sellers (to announce the close of an auction they bid on/sold), as well as to help FurBid defend or refute claims of fraud by one party against another (or against FurBid). Information collected in the course of using FurBid will be disclosed to no-one, with a few excetions (please read <B>Disclosure Exceptions</B>, thh next section)</P>

<P><B>Disclosure Exceptions</B>: FurBid respects the privacy concerns of all its users, and goes to great lengths to protect that information from any third party that should not have access to it. We will disclose the following information to another user, if and only if they were a buyer on an item you were selling, or a seller whose auction you bid on: name, e-mail address, postal mail address. No other information will be disclosed, unless required to do so by local, state, federal or international law. FurBid will be adding in the near future  an option in the registration info that will allow a user's phone number to be disclosed to the buyer/seller they are doing business with. The default will be "no" for <B>all</B> users. The option will need to be consciously be turned on, by the user, so as to protect the user's phone number if they do not wish it disclosed.</P>

<P><B>Warrenty</B>: FurBid does not validate the condition of items offered for sale, and as such there is no warrenty offered by FurBid that your purchase shall arrive intact and matching the seller's description. By registering an account you absolve Furbid, Transform.to, and its parent companies and maintainers of any and all damages, loss of property, fines and errata charges resulting from an item bid on on FurBid. If you have been defrauded by a seller (or bidder), contact the law enforcement authorities in your local area. </P>

<P><B>User behavior</B>: FurBid is a multi-user service. All users, whether buying or seller items on FurBid, are expected to conduct themselves in a manner befitting a legally binding business transaction between two or more parties. FurBid will not tolerate any user of FurBid (or anyone acting on their behalf) to harass any FurBid user via e-mail, telephone, or any other communication medium, for any reason. Harassment includes: mail bombing, making threats of physical/mental violence, making obscene or hateful statements to the person(s), or making the user afraid to share information about their auction transaction with the harasser(s) (via user feedback or other medium). If legitimate harassmetn can be proven, the harasser(s) will be warned one time. A second offense will lead to a permanent ban of the user from FurBid. If you can't at least play at being nice, we don't want you as a user, and we have no obligation to have you as one.</P>

<P><B>Agreement to terms</B>:Use of FurBid by you indicates that you agree to all above policies, that you have read and understand this page, and that you absolve FurBid and Transform.to of any and all liability related to the buying or selling of items. Like any other agreement between two private parties, you use this service at your own risk.</P>

<P><B>Beastiality is Expressly Prohibited</B>: Any art, video or other item that depicts a Beastiality theme is *not* allowed on FurBid, period. A first violation will result in the seller being warned, and the offending item(s) being immediately forfeited. A second offence will cause the seller to be deleted and banned permanently from FurBid. Please, use good judgement in posting your items.</P>

<P><B>Bidding on adult-rated material</B>: The adult categories are restricted to bidding by <B>legal adults only!</B> By bidding on items under the adult categories, you acknowlege that you are of legal age to do so. Do <B>NOT</B> bid on items in the adult category unless you are of adult age for the country of your origin. FurBid will <B>not</B> be held responsible for the sale of explicit content to minors.</P>

<P><B>Violations of Policies</B>: FurBid's User Policies is a legally binding contract between you and FurBid, and you are responsible for following the terms outlined in the User Policies as long as you are a member of FurBid. If you believe a user is violating FurBid's User Policies, or if you have a policy question, please e-mail aatheus@transfur.com</P>

<P><B>Changing of TOS</B>: As the situation mandates, FurBid may change this TOS as needed at any time. FurBid administration will make every effort possible to alert its users whenever the TOS changes. The User acknowleges that FurBid administration may not be able to alert users at times, due to adverse network conditions, wars, or Acts of God. It is the Uer's responsibility to periodically check the TOS for updates, as by continuing to use their account constitutes agreement to thie entire TOS. If at any time the User cannot agree to the TOS, the User must send an e-mail to aatheus@transfur.com, subject "Cancel account". The message *must* be sent from the e-mail address registered under their FurBid account. The User *must* quote their real name, username, address, and password in the message, to validate who they are.</P>

<P><B>Cancelling your account</B>: If you ever wish to cancel your FurBid account, send an e-mail to aatheus@transfur.com, with the subject "Account Cancel". The message must be sent from the address you registered with. In your message, include the following: you name, complete address, and password as they appear in your registration details. This will allow us to verify that you are who you say you are (i.e. not trying to close another fur's account).</P>

<P><B>Auction software errors</B>: Occasionally, due to either programmer error, machine error, bidder error, and/or webmaster error, a bid may either be placed after an item is offically closed, or an auction may close too early. By using FurBid, you agree that such errors are unintential and agree to hold FurBid and all entites connected to FurBid harmless. FurBid administration shall do its best to fix the problem to prevent its re-occurance. We're only human, after all (well, most of us are, on the outside). If you encounter such an error, let aatheus@transfur.com know, so that we can make this site the best it can be.</P>

<P><B>Copyright of site content</B> All images and text on this site, with the exception of the images included by Users in their auction items, are copyright FurBid and Jeff Orr. The names "FurBid", "FurryBid", the FurBid logo, and the domain "furbid.com" are copyright same. The banner graphics on various pages are copyright their respective copyright holders. No image may be reused, distributed, sold, leased, altered or duplicated without written from FurBid administration. The exception is any graphic specifically provided for link-to purposes, for placement on a User's site to link to FurBid. These graphics may only be used to link to FurBid from a web site that the user has control over. Depending on the severity of the copyright infraction, the user(s) account(s) may be suspended/deleted, and local law enforcement in the user'(s) area may be alerted</P>
